This Privacy Policy (“Policy”) describes the collection, use, and disclosure of your Personal Information (as defined below) by And Go Concepts, LLC, doing business as Meals and Go (“And Go Concepts,” “we,” “our,” or “us”) from users of our website at www.mealsandgo.com, and any other online properties we operate and on which this Policy appears (collectively, the “Services”). By using the Services, you consent to the collection, use, and disclosure of your Personal Information in accordance with this Policy. This Policy does not apply to any third-party websites, services, or applications, even if they are accessible through the Services.

This Policy is incorporated by reference into our Terms and Conditions and subject to the provisions of the Terms and Conditions. Defined terms in this Policy, unless otherwise defined herein, have the same meanings as in our Terms and Conditions.

Updates to this Policy

We may occasionally update this Policy. When we do, we will also revise the “last updated” date at the beginning of the Policy. Your continued use of the Services after such changes will be subject to the then-current Policy. If we change this Policy in a manner that is materially less restrictive of our use or disclosure of your Personal Information, we will notify you of the change and its effective date by posting it on the Services or by sending you an email or other notification.

Personal Information

“Personal Information,” as used in this Policy, is information that specifically identifies an individual, such as an individual’s name, email address, phone number, billing address, or credit card information. Personal Information also includes information about an individual’s activities, such as information about his or her activity on the Services, and demographic information, such as date of birth, gender, geographic area, and preferences, when any of this information is linked to Personal Information that identifies that individual.

Personal Information does not include “aggregate” or other non-identifying information. Aggregate information is information that we collect about a group or category of products, services, or users that is not personally identifiable or from which individual identities are removed. We may use and disclose aggregate information and other non-identifying information for various purposes.

This Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third-party websites, services and applications such as social networking services (“Third-Party Services”) that you elect to access through the Services, or to the practices of individuals that we do not manage or employ. While we attempt to facilitate access only to those Third-Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third-Party Services. Collection of Information

Voluntarily Provided

We collect Personal Information that our users provide to us in the following ways:

Email newsletters. If you sign-up to receive our communications or create an account (“Account”) with us, we collect your email address and may, from time to time, send you newsletters and other commercial or promotional communications about the Services. You may opt-out from receiving these communications in accordance with the “Choice” section below.
User Accounts. If you create an Account, we collect the Personal Information that you provide to us in the course of registering for the Account. We also collect information on your Meals, Meal Pickup Location, and Meal Pickup Day preferences. We do not receive or store passwords for Accounts. Additionally, credit card transactions are handled by a third-party payment processor and we do not store your credit card information.
Interactive Features. The Services may contain interactive functionality that allows you to engage with other users on the Services or Third-Party Services, post comments to forums, upload photographs and other content (the “User Materials”), participate in surveys, and otherwise interact with the Services and other users. If you use any interactive functionality on the Services or Third-Party Services that requests or permits you to provide us with Personal Information (including, for example, any services that allow you to post User Materials on the Services or Third-Party Services), we collect the Personal Information you provide in the course of using these interactive features.
Correspondence. If you contact us by email, using a contact form on the Services, mail, or other means, we collect the Personal Information contained within, and associated with, your correspondence.
Other Information. From time to time, we may collect third-party email addresses, such as of family and friends, or other contact information you provide for promotional purposes.

Passively Collected

When you access the Services, some information is collected automatically. We automatically collect your browser’s Internet Protocol (IP) address, your browser type, the nature of the device from which you are visiting the Services (e.g., a personal computer or a mobile device), the identifier for any handheld or mobile device that you may be using, the website that you visited immediately prior to accessing any web-based services, the actions you take on the Services, and the content, features, and activities that you access and participate in on the Services. We also may collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message. Service Providers

We may disclose Personal Information to third-party service providers (e.g., payment processing and data storage and processing facilities) that assist us in our work. We limit the Personal Information provided to these service providers to that which is reasonably necessary for them to perform their functions, and they are expressly obligated to maintain the confidentiality of such Personal Information.

Third Parties

We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling, and other similar purposes.

Public Areas and Syndicated Services

Some features on the Services may allow you to upload, post, or otherwise transmit User Materials to public areas of the Services, such as content that you post in a public profile on the Services. We may make these User Materials available for display upon our properties that are not governed by this Policy, as well as to services operated by third parties that display content from the website (collectively, “Syndicated Services”). Please be aware that any Personal Information that you include within any User Materials will be made available to other users of the Services, and to users of Syndicated Services, who view it. You include Personal Information in User Materials at your sole risk. Also be aware that even after information posted on the Services is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available on the Services. We cannot warrant or guarantee that any Personal Information that you provide on and in connection with the Services will not be accessed, viewed, or used by unauthorized persons.

Social Media Pages and Other Voluntary Disclosure

Please keep in mind that whenever you voluntarily disclose Personal Information online, whether it is on social media pages, on message boards, through email, in meeting rooms, or in blogs, your information can be collected and used by others. In short, if you post Personal Information online that is accessible to the public, you may receive unsolicited messages from other parties in return. We cannot control the actions of any third parties.

Further, we reserve the irrevocable, perpetual and worldwide right to copy and post on the Services and those of any parent, affiliates, subsidiaries, assigns, agents and licensees, and on any Third-Party Services and advertising media through which we are engaged, any comments, pictures or other information related to us that you post on social media pages, bulletin boards, chat rooms, blogs, or elsewhere, without any further notice to you or any remuneration. We also reserve the right to moderate any comments, pictures, or other information you post through or on such forums and media to help keep inappropriate messages from being posted.

Business Transfers

Information about our users, including Personal Information, may be disclosed and otherwise transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which Personal Information is transferred to one or more third parties as one of our business assets.

To Protect our Interests

We may disclose Personal Information if we believe that doing so is legally required, or is in our interest to protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights or property of others, or otherwise to help protect the safety or security of the Services and other users of the Services.

Choice

You may opt-out from receiving commercial email from us, and any other promotional communications that we may send to you from time to time (e.g., by postal mail) by sending your request to us by email at support@mealsandgo.com or by unsubscribing to the communication if that option is provided. Please be aware that if you opt-out of receiving promotional communications from us, it may take up to ten (10) business days for us to process your opt-out request, and you may receive promotional communications from us during that period. Additionally, even after you opt-out from receiving promotional communications, you will continue to receive administrative messages from us pursuant to our relationship with you regarding the Services.

If you request that we delete your Account, we will do so within a reasonable period of time, but we may need to retain some of your Personal Information in order to satisfy our legal obligations, or where we reasonably believe that we have a legitimate reason to do so.

Children

Children’s safety is important to us, and we encourage parents and guardians to take an active interest in the online activities of their children. The Services are not directed to children under the age of 13. If we learn that we have collected Personal Information from a child under the age of 13 on the Services, we will delete that information as quickly as possible. International Visitors

By providing your Personal Information to us through your use of the Services, you agree to that transfer, storage, and processing in the U.S. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services.

We use reasonable security measures that are designed to protect Personal Information from accidental loss, disclosure, misuse, and destruction. Please be aware, however, that no data security measures can be guaranteed to be completely effective.
